3. Order and Conclusion of Purchase Contract
3.1. Information about the goods, its main characteristics, price and availability is stated for each product. Photographs and visualisations are for informational purposes. Colours may differ between the monitor or display and the actual product; for a more accurate assessment, we recommend ordering a physical sample.
3.2. The buyer places selected goods into the shopping basket, chooses the delivery and payment method and enters the data necessary to process the order. Before sending the order, the buyer may check and correct the entered data.
3.3. By submitting an order through a button clearly indicating that the order is binding for payment, the buyer makes a binding order for the goods in the basket and confirms having read these terms and conditions.
3.4. The purchase contract is concluded at the moment the buyer receives a confirmation of order receipt sent to the e-mail address stated in the order, unless the confirmation indicates that the order requires further approval.
3.5. Before confirming the order, the buyer may be requested to confirm it again, particularly regarding quantities, price, delivery costs or unusual character of the order.
3.6. The order may not be accepted, especially if the goods are not available, the buyer has provided clearly incorrect or incomplete information, or the goods show an obviously incorrect price. The buyer will be informed without undue delay and any payment already received will be refunded.
3.7. The concluded purchase contract is stored electronically. The buyer will receive the order confirmation and these terms and conditions to the e-mail address provided in the order.
4. Price and Payment Terms
4.1. Prices of goods include VAT and all statutory fees, unless expressly stated otherwise. Delivery costs, cash-on-delivery fees, and other optional services are stated separately during the ordering process.
4.2. The purchase price may be paid by the methods offered at the time of ordering, in particular:
- cashless transfer to account no. 2101350930/2010 maintained at Fio banka, a.s.;
- cash on delivery upon receipt of the goods, if this method is available for the shipment;
- cash or card payment on personal collection, if this method is available.
4.3. In case of cashless payment, the purchase price is payable according to the instructions in the order confirmation. Goods may not be dispatched before the full purchase price is credited, unless otherwise agreed.
4.4. The seller issues the tax document and provides it to the buyer electronically or together with the goods.
4.5. Ownership rights to the goods transfer to the buyer upon full payment of the purchase price and receipt of the goods.
5. Delivery and Acceptance of Goods
5.1. The method, cost and expected delivery time are stated in the ordering process. Further information is available on the page Delivery Terms.
5.2. Unless otherwise specified for particular goods or in the order confirmation, goods will be delivered no later than 14 days after concluding the purchase contract. Goods marked as "in stock" are generally dispatched within five working days.
5.3. The buyer is obliged to accept the goods and, where possible, inspect the condition of the shipment and its packaging on receipt. If the shipment is visibly damaged, it is recommended to record this with the carrier and notify customer service without undue delay. Failure to inspect or write a delivery note with the carrier does not by itself deprive the consumer of statutory rights.
5.4. The risk of damage to the goods passes to the consumer buyer when the goods are accepted by the buyer or a third party designated by them other than the carrier. If the consumer chooses a carrier not offered by the online store, the risk passes on delivery to this carrier.
5.5. If the buyer does not accept the shipment without justified reason, this does not automatically constitute withdrawal from the contract. The seller may demand compensation for actual and reasonably incurred costs resulting from the failure to accept the shipment.
5.6. If the buyer is in delay accepting the goods, the seller may set a reasonable additional deadline for acceptance after prior warning. After its expiry without acceptance, legal regulations may be applied.
6. Consumer Withdrawal from the Contract
6.1. The consumer may withdraw from a contract concluded through the online store for any reason within 14 days.
6.2. The period begins on the day the consumer or a third party designated by them other than the carrier takes delivery of:
- the goods;
- the last piece of goods, if multiple pieces are delivered separately within one order;
- the last item or part of the delivery, if the goods consist of multiple items or parts;
- the first delivery of goods if periodic delivery over time has been agreed.
6.3. The consumer may withdraw by any unequivocal statement sent to customer service, e.g. email or letter. The consumer may also use the model withdrawal form available in the online store, although its use is not obligatory.
6.4. To meet the deadline, it is sufficient for the consumer to send the withdrawal declaration before the expiry of the period. Withdrawal is also possible before taking receipt of goods.
6.5. The consumer shall send or hand over the goods without undue delay, no later than 14 days from withdrawal, to the address: Střelice 727, 664 47 Střelice. Shipments sent cash on delivery may not be accepted.
6.6. Direct costs of returning the goods are borne by the consumer. The consumer may use return shipping arranged by customer service at a price of 150 Kč including VAT per parcel with one tracking number. This amount may be deducted from the refunded amount after agreement.
6.7. The seller will refund the consumer without undue delay, no later than 14 days from withdrawal, all amounts received from the consumer under the contract, including the costs of the cheapest offered delivery method.
6.8. Funds will be refunded in the same manner as received unless the parties agree otherwise without further cost to the consumer. The seller is not obliged to refund the funds before receiving the returned goods or before the consumer provides proof of dispatch, whichever occurs first.
6.9. The consumer is liable only for any diminished value of the goods resulting from handling the goods in a way other than necessary to establish their nature, properties and functionality.
6.10. Original packaging is not a condition for withdrawal. However, the consumer must suitably pack the goods for transport to prevent damage.
6.11. In case of withdrawal regarding only part of the order, only the purchase price of the returned goods is refunded. The delivery costs are refunded to the extent corresponding to legal regulations and specific order circumstances.
6.12. The consumer cannot withdraw especially from contracts:
- for the supply of goods made or customised according to the consumer's individual requirements or made to a personalised colour variant that is not offered as standard;
- for the supply of goods that are liable to deteriorate quickly or have a short expiry date;
- for the supply of goods that were irreversibly mixed with other goods after delivery due to their nature;
- for the supply of goods in sealed packaging which the consumer has removed from the packaging and which cannot be returned for hygienic reasons;
- on providing the service, which was fully rendered with the prior explicit consent of the consumer and after being informed that the right of withdrawal expires upon full provision of the service;
- in other cases stipulated by § 1837 of the Civil Code.
6.13. Selecting a standard offered shade or product variant alone does not mean the goods have been customised according to the individual wishes of the consumer. The exception applies only when the legal conditions are met.
7. Consumer rights concerning defective performance
7.1. The seller is liable to the consumer that the goods are free from defects upon delivery. The goods must particularly correspond to the agreed description, type, quantity and quality, be suitable for the agreed purpose, and be supplied with the agreed accessories and usage instructions.
7.2. Unless otherwise agreed in accordance with the law, the goods must also correspond to the properties, quantity, quality, functionality, compatibility, safety and other characteristics that the consumer can reasonably expect considering the nature of the goods and public statements made by persons within the supply chain.
7.3. The consumer may claim a defect that appears in the goods within two years of taking delivery. If the defect appears within one year of delivery, it is presumed the goods were defective at delivery, unless the nature of the goods or defect excludes this.
7.4. For used goods, the parties may shorten the period for claiming defects to one year; such shortening must be agreed before the contract is concluded.
7.5. If the goods are defective, the consumer may demand its rectification. At their discretion, they may require repair of the goods or delivery of a new non-defective item, unless the chosen remedy is impossible or disproportionately expensive compared to the alternative.
7.6. Rectification may be refused if it is impossible or disproportionately costly, especially considering the significance of the defect and the value the goods would have without the defect.
7.7. The defect will be rectified free of charge, within a reasonable time after it is reported, and without causing significant inconvenience to the consumer. The seller will take the goods for rectification at their own expense.
7.8. The consumer may demand a reasonable discount or withdraw from the contract if:
- the seller refused to remedy the defect or did not properly do so;
- the defect recurs;
- the defect constitutes a fundamental breach of contract;
- it is evident from the seller’s statement or circumstances that the defect will not be remedied within a reasonable time or without significant inconvenience to the consumer.
7.9. The consumer cannot withdraw from the contract if the defect is insignificant. It is presumed that the defect is not insignificant until the seller proves otherwise.
7.10. The seller is not liable for defects caused by the buyer, for normal wear and tear, or for defects consistent with the level of use for used goods.
7.11. For construction, coating and application materials, the goods are not considered defective if the result was caused especially by an unsuitable or unprepared substrate, failure to follow the technological procedure, use of non-system products, inappropriate conditions during application or curing, improper storage, usage beyond the expiration date or intervention by another party, provided the goods were not defective at delivery.
7.12. Natural variations in colour, texture and pattern consistent with the character of a hand-applied decorative surface are not considered a defect by themselves. The final appearance is influenced, among other factors, by the substrate, application method, tools, lighting and production batch used.
8. Filing and processing complaints
8.1. Complaints may be filed through the customer service specified in Article 2, personally or by post to Střelice 727, 664 47 Střelice.
8.2. The buyer should provide their contact details, order number or other information enabling order identification, description of the defect, when and how the defect appeared, and the desired resolution method. The purchase can be demonstrated by other credible means besides the original receipt or invoice.
8.3. For application materials, photo documentation, batch number, information about the substrate, storage and application conditions, and a description of the procedure used may be required to properly assess the complaint. This information will be requested only to the extent reasonably necessary for evaluation.
8.4. When submitting a complaint, the consumer will receive written confirmation stating the date of complaint submission, its content, the requested resolution method and contact information for updates on processing.
8.5. A decision on the complaint will be made immediately, or in complex cases no later than three working days. The timeframe does not include a reasonable period needed for expert assessment depending on the type of goods.
8.6. The consumer’s complaint, including defect rectification, must be completed and the consumer informed without undue delay, no later than 30 days from the complaint date, unless the parties agree on a longer period.
8.7. If this period elapses without resolution, the consumer may withdraw from the contract or request a reasonable discount.
8.8. The consumer will receive written confirmation of the date and manner of complaint resolution, including evidence of repair and its duration, or a written justification of the complaint’s rejection.
8.9. For a justified complaint, the consumer is entitled to reimbursement of reasonable costs incurred. The right to reimbursement should be asserted without undue delay.
8.10. More detailed organisational information is provided on the page Complaints Procedure.
9. Buyer as a business entity
9.1. Rights of buyers who are not consumers are governed mainly by the general provisions of the Civil Code on sales contracts and defective performance.
9.2. The business buyer is obliged to inspect the goods as soon as possible after the risk of damage passes and must notify any discovered defect without undue delay after it could reasonably have been discovered with due care.
9.3. If defective performance constitutes a fundamental breach of contract, the business buyer has rights established by the Civil Code, particularly the right to have the defect remedied, a reasonable discount, or withdrawal from the contract depending on the nature of the defect and their chosen remedy.
9.4. A quality guarantee is provided only if expressly granted by the seller or manufacturer in a warranty statement, technical sheet, packaging, or another legally stipulated manner.
10. Personal data protection and commercial communications
10.1. Personal data is processed mainly for the purposes of concluding and fulfilling the sales contract, handling orders and complaints, fulfilling legal obligations, and protecting legitimate claims.
10.2. Details about the scope of processing, legal bases, retention period, recipients of data and data subjects’ rights are governed by a separate document titled “GDPR – Personal Data Protection,” available in the online shop.
10.3. Commercial messages may only be sent in compliance with applicable legal regulations. The recipient may refuse receiving such messages at any time easily and free of charge.
11. Out-of-court consumer dispute resolution
11.1. If a dispute arises between the seller and consumer from the sales contract that cannot be resolved by mutual agreement, the consumer may submit a proposal for out-of-court consumer dispute resolution.
11.2. The competent authority for out-of-court resolution of consumer disputes is:
Czech Trade Inspection Authority
Central Inspectorate – ADR Department
Gorazdova 1969/24
120 00 Prague 2
e-mail: adr@coi.gov.cz
web: coi.gov.cz/informace-o-adr/
11.3. Proposals must be submitted no later than one year after the consumer first asserted their right at issue to the seller.
11.4. The European Online Dispute Resolution platform (ODR) has been discontinued and is no longer available for submitting proposals.
11.5. Supervision over compliance with obligations under Act No. 634/1992 Coll., on Consumer Protection, is carried out by the Czech Trade Inspection Authority.
12. Gifts, discounts and individual offers
12.1. If a gift is provided together with the goods, the gift contract is concluded with the resolutive condition that if the buyer withdraws from the sales contract concerning the goods to which the gift relates, they must also return the associated gift, unless agreed otherwise by the parties.
12.2. Conditions of specific discount or loyalty promotions stated in the online shop take precedence over the general rules of this article.
12.3. Unless otherwise specified in a particular promotion:
- only one discount code can be used per order;
- the discount code cannot be redeemed for cash or split among multiple orders;
- the discount code cannot be combined with an individual price offer;
- the discount code does not apply to shipping, cash on delivery, packaging or other supplementary services;
- when returning goods, the refund equals the actual amount paid for the returned goods after proportionally accounting for the discount applied.
12.4. These restrictions must not diminish the consumer’s statutory rights.
13. Information on use of goods
13.1. The buyer is obliged to study the technical data sheet, safety data sheet, application procedure and other instructions supplied with the goods or made available in the online shop or by the manufacturer before use.
13.2. Oral or written recommendations from customer service are based on available information, experience and manufacturer data. They do not replace expert assessment of a specific substrate, construction, environment, or intended method of use.
13.3. If the buyer doubts the suitability of the product or system composition, they should perform a test on a smaller area or seek expert assessment before application. This does not affect the buyer’s statutory rights.
14. Final provisions
14.1. Legal relations are governed by the legal order of the Czech Republic, particularly Act No. 89/2012 Coll., the Civil Code, and in relation to the consumer, Act No. 634/1992 Coll., on Consumer Protection. Choosing Czech law does not deprive the consumer of the protection provided by the mandatory provisions of the law of their habitual residence if applicable.
14.2. If any provision of these terms and conditions is invalid or ineffective, this shall not affect the validity and effectiveness of the remaining provisions.
14.3. The terms and conditions may be amended for future orders. For a specific purchase contract, the wording effective at the time the order is placed by the buyer shall apply.
14.4. These terms and conditions are effective from 18 July 2026.
